A. FOR THE SUPPLY OF PHYSICAL GOODS FOR SALE ON ANY OF TOMBSTONE MEDIA'S WEBSITES AND INSTRUCTIONS FOR TERMS RELATING TO PROJECTS UNDERTAKEN FOR CLIENTS
1) THE CONTRACT BETWEEN US
Tombstone Media must receive payment of the whole of the price of the goods that you order before your order can be accepted. Once payment has been received we will confirm that your order has been accepted by PayPal sending a confirmation email to you at the email address you provide in your order form.
2) PRICE
The prices payable for physical goods that you order directly from our websites are set out on our websites.
3) AVAILABILITY OF GOODS AND SERVICES YOU ORDER
I. The total cost of your order is equal to the price of the items and/or services ordered.
II. Availability: We will do our best to fulfil your order within the time stated, but we cannot guarantee this in every instance. We will inform you of any problems immediately. If a design project is undertaken for you the client by Tombstone Media, we will document prices and completion deadlines during the final consultation between Tombstone Media and the client prior to undertaking the project, which are separate from delivery times with the terms of use on this page.
III. Shopping at Tombstone Media is safe. All of the information you give us is private and secure. Payments are handled securely by PayPal Europe. We do not sell or rent information about our customers under any circumstances.
4) DELIVERY OF GOODS AND SERVICES TO YOU
I. Tombstone Media will always endeavour to deliver, within six weeks, the physical goods ordered by you directly from our websites to the address you give us for delivery at the time you make the order. For designs undertaken for clients, please refer to final consultation documentation for terms relating specifically to that item of business, as they will be different from the terms of use on this page.
II. Delivery will be made as soon as possible after your order is accepted, and will be either personally delivered or sent via first class post once the items order are ready to be sent to you.
III. You will become the owner of the physical goods you have ordered directly from our websites when they have been delivered to you. Once the goods have been delivered to you they will be held at your own risk and Tombstone Media will not be liable for their loss or destruction. For projects undertaken for clients, the project contents will become the client's complete property upon delivery, if no further work is to be done on the project by Tombstone Media.
5) LIABILITY
I. If the physical goods you ordered directly from our websites are not correct, are damaged, defective or the delivery is an incorrect quantity you must notify Tombstone Media in writing or via formal e-mail within 30 days of receiving the order. In line with UK Distance Selling Regulations you may return the goods to us in their original condition (the exact condition in which you received them) within 30 days of your order for a complete refund, once Tombstone Media collects a refund from any outside supplier. If the projects undertaken by clients are not completely satisfactory, the client should contact Tombstone Media personally for a resolution, as further consultation will then need to commence.
II. If you do not receive physical goods ordered by you directly from our websites within six weeks of the date on which you ordered them you must notify us immediately.
III. If you notify a problem to Tombstone Media under condition 5ii, we will, at your preference, either:

Make good any shortage or non-delivery; or
-
Replace any goods that are damaged or defective; or
-
Refund to you the amount paid for the goods.
6) FORCE MAJEURE
Tombstone Media shall not be liable for any default due to any act of God, war, civil commotion, strike, lock-out, industrial action, fire, flood, drought, storm or other event beyond its reasonable control.
7) INVALIDITY
If any part of these conditions is unenforceable the enforceability of any other part of these conditions will not be affected.
8) INTERPRETATION
In these terms and conditions:-
i. “Tombstone Media” means the owner of the website
and, where appropriate, any other person involved in
the input and maintenance of the websites associated;
ii. “working day” means every day of a calendar year apart from weekends
and statutory and public holidays;
iii. “us” and "we" means Tombstone Media and
appropriately affiliated parties; and
iv. “you” and “your”
means the person ordering the goods under these terms and conditions.
9) ADVERTISING ON TOMBSTONE MEDIA'S WEBSITES
Tombstone Media does not have a rigid pricing structure for external advertising. If anyone wishes to advertise on any of the Tombstone Media websites, they should contact Tombstone Media for consultation, where the final price of the advertising will be mutually agreed upon.
10) TERMS FOR CLIENTS OF TOMBSTONE MEDIA'S DESIGN AND/OR HOME SUPPORT SERVICES
Please read the relevant terms and conditions, specific to each service offered by Tombstone Media, in the Services area of this website. Terms and conditions for clients of Tombstone Media's Design Services or Home PC Support Services are different from those relating to the sale of physical goods to a customer via a Tombstone Media owned website.
B. PROHIBITED USE OF THE WEBSITE FACILITIES BY NON-MEMBERS
1) MEMBERS
Members are defined as those persons with a valid, and accepted by Tombstone Media, personal login account. Only these persons can access members-only features, including participating on the forums. To become a member you must register with one of the Tombstone Media websites. Your membership will then be reviewed by the owners of Tombstone Media, and if successful, your account shall remain active. If unsuccessful, your account will be deleted. Tombstone Media reserves the right to remove any personal account at any time and does not have to provide a reason to the removed parties. Persistent applications from previously removed parties shall lead to any IP addresses or other identifiable information being blocked from the login process.
2) NON-MEMBERS
Non-members are any persons that do not have - or have had removed - a valid, and formally accepted by Tombstone Media, personal login account. Non-members are strictly prohibited from using the Tombstone Media members-only features. It is at the discretion of Tombstone Media to designate the status of "member" to a person. Should a membership be cancelled and removed, all priorities and advantages of having the status of member will also be removed at that time. Malicious contact with anybody associated with Tombstone Media as a result of encountering personal details of members shall result in prosecution to the fullest extent of the law.
