Terms of Use:

FOR THE SUPPLY OF PHYSICAL GOODS FOR SALE ON ANY OF OUR WEBSITES
1) THE CONTRACT BETWEEN US
We must receive payment of the whole of the price of the goods that
you order before your order can be accepted. Once payment has been received we
will confirm that your order has been accepted by PayPal sending a confirmation
email to you at the email address you provide in your order form.
2) PRICE
The prices payable for physical goods that you order directly from our
websites are set out on our websites.
3) AVAILABILITY OF GOODS AND SERVICES YOU ORDER
I. The total cost of your order
is equal to the price of the items and/or services ordered.
II. Availability: We will do
our best to fulfil your order within the time stated, but we cannot guarantee
this in every instance. We will inform you of any problems immediately. If a
design project is undertaken for you the client by us, we will
document prices and completion deadlines during the final consultation between
us and the client prior to undertaking the project, which
are separate from delivery times with the terms of use on this page.
III. Shopping on any Tombstone Media website is safe. All of the
information you give us is private and secure. Payments are handled securely by
PayPal Europe. We do not sell or rent information about our customers under any
circumstances.
IV. There are additional terms and conditions

4) DELIVERY OF GOODS AND SERVICES TO YOU
I. We will always endeavour to deliver,
within six weeks, the physical goods ordered by you directly from our websites to the address you give us for
delivery at the time you make the order. Some goods, for example selected items
in the TM Wrestling shop, are manufactured in the USA. As a result, some orders
may indeed take up to six weeks to dispatch For designs undertaken for clients,
please refer to final consultation documentation for terms relating specifically
to that item of business, as they will be different from the terms of use on
this page.
II. Delivery will be made as
soon as possible after your order is accepted. We now offer several types of
postage, based on the weight of the total order. For "First Class" and "Standard
Parcels" postage, we aim to dispatch within three working days of the order
being placed on items we hold in stock. For items made to order, we aim to
dispatch the goods to you within three working days of the item being ready for
you. Items that are made to order may take up to six weeks to be ready. Where an
order placed by you contains a mixture of items that are "made to order" and
items that we currently hold in stock, we will dispatch the items available
sooner separately from those that will take longer.
III. There may be some occasions where business will be
suspended due to the website not being monitored for any period of time.
This will be noted (in large red text) at the top of the page on the
home page of each site and pages where items are sold from. Any orders placed whilst
"out of office" status is applied, will not be processed until the
office re-opens, regardless of postage options chosen. Please look for
this message before placing an order.
IV. You will become the owner of the physical goods you have ordered
directly from our websites when they have
been delivered to you. Once the goods have been delivered to you they will be
held at your own risk and we will not be liable for their loss or
destruction. For projects undertaken for clients, the project contents will
become the client's complete property upon delivery, if no further work is to be
done on the project by us.
5) LIABILITY
I. If the physical goods you ordered directly from
our websites are not correct, are damaged, defective or the delivery is an
incorrect quantity you must notify us in writing or via formal
e-mail within 30 days of receiving the order.
In line with UK Distance Selling Regulations you may return the goods to
us in their original condition (the exact condition in which you received them) within 30 days of your order for a complete
refund, once we collect a refund from any outside supplier. If the
projects undertaken by clients are not completely satisfactory, the client
should contact us personally for a resolution, as further
consultation will then need to commence.
II. If you do not receive physical goods
ordered by you directly from our websites within six weeks of the date on which you ordered them you
must notify us immediately.
III. If you notify a problem to us under condition
5ii, we will, at
your preference, either:
-
Make good any shortage or non-delivery; or
-
Replace any goods that are damaged or defective; or
-
Refund
to you the amount paid for the goods.
During this time, we would chase the error with the manufacturer.
This may require an unspecified amount of time. Therefore you shall
be obliged to wait for the result of the query until said result is
found, at which point we will contact you.
6) FORCE MAJEURE
We shall not be liable for any default due to any act of God, war, civil
commotion, strike, lock-out, industrial action, fire, flood, drought, storm or
other event beyond its reasonable control.
7) INVALIDITY
If any part of these conditions is unenforceable the enforceability of any other part
of these conditions will not be affected.
8) INTERPRETATION
In these terms and conditions:-
i. “Tombstone Media” means the owner of the website
and, where appropriate, any other person involved in
the input and maintenance of the websites associated;
ii. “working day” means every day of a calendar year apart from weekends
and statutory and public holidays;
iii. “us” and "we" means Mr Allen and
appropriately affiliated parties; and
iv. “you” and “your”
means the person ordering the goods under these terms and conditions.
9) ADVERTISING ON OUR WEBSITES
We do not have a rigid pricing structure for external
advertising. If anyone wishes to advertise on any of our
websites, they should contact us for consultation, where the final
price of the advertising will be mutually agreed upon.
B.
PROHIBITED USE OF THE WEBSITE FACILITIES BY NON-MEMBERS
1) MEMBERS
Members are defined as those persons with a valid, and accepted by Tombstone
Media, personal login account. Only these persons can access members-only
features, including participating
on the forums. To become a member you must register with
one of the Tombstone Media websites. Your membership will then be reviewed by
the owners of Tombstone Media, and if successful, your account shall remain
active. If unsuccessful, your account will be deleted. Tombstone Media reserves
the right to remove any personal account at any time and does not have to
provide a reason to the removed parties. Persistent applications from previously
removed parties shall lead to any IP addresses or other identifiable information
being blocked from the login process.
2) NON-MEMBERS
Non-members are any persons that do not have - or have had removed - a valid,
and formally accepted by Tombstone Media, personal login account.
Non-members are strictly
prohibited from using the Tombstone Media members-only features. It is at the
discretion of Tombstone Media to designate the status of "member" to a person.
Should a membership be cancelled and removed,
all priorities and advantages of having the status of member will also be
removed at that time. Malicious contact with anybody associated with Tombstone Media as a
result of encountering personal details of members shall result in prosecution
to the fullest extent of the law.
